IP/Trademark Lawyer Needed – Cease & Desist from App

I am the director of a Dutch private limited company (B.V.) and have received a cease-and-desist letter dated 12 February 2026 from Apple Inc., sent by LXA N.V..

Apple alleges that my company sold cables via bol.com that infringe its EU trademark rights. According to Apple, the products are counterfeit.

The cables in question were purchased by my company as original products from a supplier based in Italy. At the time of purchase, we understood them to be genuine Apple products.

Apple has enclosed a comprehensive settlement declaration requiring, among other things:

Formal admission of trademark infringement

Immediate cessation of sales

Full disclosure of purchase and sales records (including supplier details)

Surrender and destruction of remaining stock

Contractual penalties (€1,000 per breach / €500 per day / €50 per product)

Payment of €1,500 advance damages

Payment of €1,750 legal costs

Jurisdiction clause designating The Hague

Reference to full legal cost recovery under Article 1019h Dutch Code of Civil Procedure (indicative litigation costs approx. €9,600+)
